Gilchrist County [Florida] Commissioners have been notified that their recent decision to reject plans for a water bottling plant is being challenged in court.
Blue Springs Properties had requested a special use permit to build a water bottling plant on the Santa Fe River. In September the commissioners voted four-to-one to deny the permit application.
Blue Springs has filed a petition asking a judge to consider whether commissioners had substantial competent evidence to deny the request. Blue Springs officials have also claimed that because not enough time was allowed to cross-examine all speakers, their due process rights were ignored.
If a judge approves the petition, the matter would go back to the commission for reconsideration.
